DMCA and Copyright Policy
Last updated: September 3, 2026
Transparent Marketing, which owns and operates The Client Engine at www.SpeedScaling.com (the "Site"), respects the intellectual property rights of others and expects users of the Site to do the same. This policy explains how we respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. Section 512 ("DMCA").
1.Our Content
Unless otherwise noted, the content on the Site, including text, graphics, logos, images, video, audio, frameworks, and course materials, is owned by or licensed to Transparent Marketing and is protected by United States and international copyright and other intellectual property laws. You may not copy, reproduce, republish, distribute, or create derivative works from our content without our prior written permission.
2.Reporting Alleged Copyright Infringement
If you believe in good faith that content on the Site infringes a copyright you own or control, you may send a written notice to our Designated Copyright Agent using the contact details below. To be effective under the DMCA, your notice must include substantially the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
- Identification of the material that you claim is infringing and that you want removed or disabled, with information reasonably sufficient to let us locate it, such as the URL where it appears.
- Your contact information, including your name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
Please note that under 17 U.S.C. Section 512(f), you may be liable for damages, including costs and attorney fees, if you knowingly and materially misrepresent that material is infringing.
3.Designated Copyright Agent
Please send all DMCA notices to our Designated Copyright Agent:
Fred Smith, Copyright Agent
Transparent Marketing (operating The Client Engine)
P.O. Box 1066, Jurupa Valley, CA 91752
Email: [email protected]
For a faster response, please include "DMCA Notice" in the subject line of your email. Notices that do not include the required information above may not be valid or actionable.
4.Our Response and Removal
Upon receiving a valid notice, we will act expeditiously to remove or disable access to the material claimed to be infringing, and we may notify the person who posted or provided that material. We reserve the right to remove any content at any time, with or without notice, for any reason.
5.Counter-Notification
If you believe your material was removed or disabled by mistake or misidentification, you may send a written counter-notification to our Designated Copyright Agent. To be effective, your counter-notification must include substantially the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before it was removed or disabled.
- A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who filed the original notice or their agent.
If we receive a valid counter-notification, we may restore the removed material in not less than 10 and not more than 14 business days after receipt, unless our Designated Copyright Agent first receives notice from the original complaining party that they have filed an action seeking a court order to restrain the allegedly infringing activity.
6.Repeat Infringers
Transparent Marketing has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the access or accounts of users who are deemed to be repeat infringers.
7.Third-Party and Platform Content
The Site is hosted and served through third-party providers, and certain features or content may be operated by third parties. Those providers maintain their own copyright and DMCA procedures. Nothing in this policy limits any rights or remedies available under the policies of those providers or under applicable law.
8.Changes to This Policy
We may update this policy from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes are posted means you accept the updated policy.
